Summary of Protective and Restrictive Covenants

The following summary has been prepared to assist the homeowners in identifying and correcting violations with the governing Protective and Restrictive Covenants and By-laws of our subdivision. These rules have been established to promote the overall appearance and desirability of our neighborhood and to develop and maintain the recreational value of our common land.

Protective and Restrictive Covenants

  1. Transfer by deed certain land for... various uses of a recreational nature.
  2. Restricts all lots to residential, single family dwellings. This restriction also covers minimum floor size, number of stories (2), use of billboards, use of temporary structures, construction duration and landscaping.
  3. Limits noxious or offensive trade or activities.
  4. Requires buildings to conform to state, city and township zoning laws and covenants.
  5. Requires building plan approval by developer.
  6. Requires driveway approaches of concrete or tarvia.
  7. Requires property between front lot line and pavement to be sodded by owner.
  8. Requires concrete sidewalks installed by owner.
  9. Covers enforcement of these covenants by civil proceedings.
  10. Covers invalidation of portions of covenants.
  11. States covenants run with land and shall be effective in perpetuity.
